Article 1 — Purpose and acceptance
These Terms govern sales of products concluded at a distance on the odorare.fr website. Any order implies full and unreserved acceptance of the Terms in force on the day of the order, which the Customer declares to have read before validating the order. Odorare reserves the right to amend them at any time, the applicable Terms being those online on the date of the order.
Article 2 — Products
The products offered are those shown on the website on the day it is consulted, while stocks last. Each product page specifies the essential characteristics of the product as well as the regulatory information applicable to cosmetic products (function, volume, precautions for use and composition), in accordance with Regulation (EC) No 1223/2009.
The photographs illustrating the products are as accurate as possible but do not constitute a contractual commitment as to the exact rendering of colours and materials, without this depriving the Customer of the legal guarantee of conformity.
Article 3 — Prices
Prices are stated in euros, excluding delivery costs. For deliveries in France and within the European Union, they are inclusive of all taxes. For deliveries outside the VAT territory of the European Union, which excludes in particular the French overseas departments, regions and collectivities, they are exclusive of French VAT. The applicable delivery costs are indicated before the order is finally validated.
The applicable price is the one displayed on the product page at the time of the order. In the event of a discrepancy between the price displayed on another page of the website and the price on the product page, the latter shall prevail.
For deliveries outside the European Union, customs duties, import taxes and customs clearance fees are not included in the price: they are payable by the Customer, under the conditions set out in Article 7 bis.
Article 4 — Orders
The Customer selects the products, checks the details of their order and its total price, corrects any errors where applicable, and then confirms the order by clicking on the button labelled “order with obligation to pay” or an equivalent wording. This confirmation constitutes acceptance of these Terms and formation of the contract.
A summary acknowledgement of receipt is sent to the Customer by email as soon as possible.
Odorare reserves the right to refuse or cancel any order that appears abnormal, that involves a previous payment dispute or that is suspected of fraud; the Customer is then informed and refunded in full.
Article 5 — Payment
Payment is made by bank card or by any other means of payment offered on the website at the time of ordering. Payment data is transmitted in encrypted form and processed directly by the payment service providers; Odorare does not have access to the complete bank details.
Article 6 — Availability
If a product is unavailable after the order has been placed, the Customer is informed as soon as possible and may cancel their order. The corresponding sums are then refunded no later than 14 days after their request.
Article 7 — Delivery
Products are delivered to the address specified by the Customer. Odorare ships within France and internationally. Deliveries to the United States and Ukraine are temporarily suspended.
Delivery methods offered: Colissimo (La Poste) home delivery against signature and, in metropolitan France only, ShopToShop relay point delivery. Delivery costs depend on the destination zone; they are indicated, together with the indicative delivery times, when ordering and on our Delivery page.
Orders are dispatched within 48 working hours of payment confirmation. A tracking number is sent to the Customer upon dispatch.
In accordance with Article L.216-1 of the French Consumer Code, where no delivery date is specified, the Seller shall deliver the goods without undue delay and no later than 30 days after the conclusion of the contract. If the Seller fails to do so, the Customer may, after having called upon the Seller to deliver within a reasonable additional period, terminate the contract and obtain a refund of the sums paid no later than 14 days after termination (Articles L.216-6 and L.216-7).
In accordance with Article L.216-4 of the French Consumer Code, the risk of loss of or damage to the products passes to the Customer when the Customer, or a third party designated by the Customer, takes physical possession of the products. If a parcel is damaged, lost or stolen in transit, the Customer contacts Odorare, which handles the claim with the carrier.
If the Customer enters an incorrect address or if a parcel is not collected within the period set by the carrier, the reshipping costs are borne by the Customer.
Article 7 bis — Deliveries outside the European Union: duties, taxes and refusal of parcels
1. Duties and taxes payable by the Customer. For any delivery outside the VAT territory of the European Union, including to the French overseas departments, regions and collectivities, customs duties, import taxes (VAT or local tax, octroi de mer, etc.) and customs clearance fees charged by the carrier or the customs authorities of the destination country are not included in the price. They are payable exclusively by the Customer, who pays them to the carrier or the customs authorities upon delivery.
2. Indicative estimate. The estimate of these charges displayed in the basket is provided for information purposes only and is not binding on Odorare: only the amount set by the authorities and the carrier of the destination country is authoritative.
3. Express acceptance. Before validating their order, the Customer ticks a box by which they acknowledge having been informed of these charges, agree to pay them and accept the conditions of this article. This acceptance is recorded with their order.
4. Refusal or non-payment. In the event of refusal of the parcel, non-payment of duties and taxes or failure to collect the parcel within the time allowed, all resulting costs are borne by the Customer: outbound shipping costs, costs of returning the parcel to Odorare, and custody, storage or destruction fees charged by the carrier or the customs authorities. These costs are deducted from the amount refunded, which may only cover the price of the products actually returned to Odorare in their original condition.
5. Destroyed or abandoned parcel. If the parcel is destroyed or abandoned at customs following the Customer’s refusal or non-payment, no refund can be made.
6. Return risks. As the Customer has accepted these conditions, the risks associated with the return of the parcel following their refusal or non-payment (loss, theft, damage) are borne by the Customer; in such a case, no refund can be made.
7. Supporting documents. Upon simple request, Odorare will provide the Customer with supporting documents for the costs deducted (carrier or customs invoices).
Article 8 — Right of withdrawal
The Customer has a period of 14 days from receipt of the products to exercise their right of withdrawal without having to give reasons for their decision or pay any penalty (Articles L.221-18 et seq. of the French Consumer Code).
The procedure for exercising this right, the model withdrawal form, the return and refund periods and the exceptions applicable to products unsealed for hygiene reasons (Article L.221-28 4°) are set out in our withdrawal and refund policy, which forms an integral part of these Terms.
In summary: the direct costs of returning the products are borne by the Customer; the refund, including standard outbound delivery costs, is made no later than 14 days after notification of the withdrawal, and Odorare may withhold this refund until it has received the product back or proof of its dispatch.
Article 9 — Legal guarantees
All products benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
Information on the legal guarantees
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event that a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in return for giving back the goods, if: 1° the trader refuses to repair or replace the goods; 2° the repair or replacement of the goods takes place after a period of thirty days; 3° the repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods; 4° the lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand. The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for the purpose of repair or replacement suspends the remaining guarantee period until the goods, restored to proper condition, are delivered.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund in return for giving back the goods.

Neither party may be held liable for any failure resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code.
Article 15 — Partial invalidity
If any provision of these Terms is declared null and void or unenforceable, the other provisions shall remain in full force and effect.
Article 16 — Applicable law and disputes
These Terms are governed by French law. In the event of a dispute, the Customer may bring proceedings, at their choice, before one of the courts having territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they resided at the time the contract was concluded or the harmful event occurred (Article R.631-3 of the French Consumer Code).
